1. Who we are

Green Apples (the “Service”) is operated by CRE8TIVE SPACES™ (“we”, “us”, “our”). By accessing or using the Service you are entering into a binding agreement with CRE8TIVE SPACES™.

2. Acceptance of these terms

By creating an account, subscribing, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use the Service. You must be of legal age in your jurisdiction or have the authority to bind the organization you represent.

3. The Service

Green Apples is a software product that provides educational frameworks, pre-recorded audio scripts, interactive simulators, and AI-assisted digital tools for sports families. It is a self-serve web application. Green Apples is not a coaching, counseling, advisory, consulting, medical, clinical, legal, or financial service, and we do not provide one-to-one professional services or match users with human coaches, therapists, or advisors. All content is for general educational and informational purposes only and is not medical, clinical, psychological, legal, or financial advice, diagnosis, or treatment.

4. Account & accurate information

You are responsible for keeping your credentials confidential and for all activity under your account. You agree to provide accurate information and to keep it up to date.

5. Acceptable use

Your use of the Service is governed by our Acceptable Use Policy, which is incorporated into these Terms by reference. In particular, you may not:

• use the Service for unlawful, fraudulent, harassing, or harmful purposes;
• infringe any intellectual property, privacy, publicity, or other rights of third parties;
• upload malware, probe, scan, or attempt to compromise the Service’s security;
• scrape, reverse engineer, resell, redistribute, or circumvent technical limits of the Service;
• use outputs in regulated professional contexts (medical, clinical, legal, financial) without qualified human oversight;
• generate human-like faces, face swaps, deepfakes, voice impersonations, or any content using a person’s likeness without their explicit, verifiable consent;
• upload identifying media of minors or use the Service to generate any sexual, exploitative, or otherwise harmful content involving minors.

5a. AI-generated content

The Service uses generative AI to produce scripts, summaries, and simulated dialogue. AI output may be inaccurate, incomplete, biased, or unsuitable for your situation. You are responsible for reviewing outputs, exercising your own judgment, ensuring you have the rights to any input you provide, and not relying on AI output for regulated professional decisions. We may filter, refuse, or remove outputs at our discretion. Do not attempt to jailbreak or bypass safety filters.

5b. Child safeguarding

Accounts may only be created by adults aged 18 or older. Where content relates to a minor, the account holder must be the minor’s parent or legal guardian, or have the guardian’s permission, and is solely responsible for that content.

6. Intellectual property

CRE8TIVE SPACES™ retains all rights, title, and interest in and to the Service, including the software, frameworks, content, branding, and trademarks. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with your chosen plan.

7. User content

You retain ownership of content you submit. You grant us a limited license to host, store, and process that content solely to provide and improve the Service.

8. Payments, subscriptions, and Merchant of Record

Our order process is conducted by our online reseller Stripe. Stripe is the Merchant of Record for all our orders. Stripe provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Stripe’s End User Terms. Subscriptions renew automatically at the cadence you select (weekly or monthly) until cancelled.

9. Service level

We do our best to keep the Service available, but we do not guarantee that it will be uninterrupted, timely, secure, or error-free.

10. Warranties & disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of liability

To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service is capped at the fees you paid to Stripe for the Service in the twelve (12) months preceding the claim. We are not liable for indirect, consequential, special, or incidental damages, including lost profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury caused by negligence where such exclusion is not permitted by law.

12. Indemnity

You agree to indemnify and hold CRE8TIVE SPACES™ harmless from any claims arising out of your user content, your unlawful use of the Service, or your violation of these Terms.

13. Suspension & termination

We may suspend or terminate your access for material breach, non-payment, security or fraud risk, or repeated or serious policy violations. On termination, your right to use the Service ends; you may export your data for a reasonable period after which it may be deleted.

14. Governing law & disputes

These Terms are governed by the laws of the jurisdiction in which CRE8TIVE SPACES™ is established, without regard to conflict of law principles. Disputes will be resolved in the competent courts of that jurisdiction, except where applicable consumer law grants you the right to bring proceedings elsewhere.

15. Assignment & force majeure

You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of assets. Neither party is liable for delays caused by events beyond reasonable control.
